2. General Information on Data Processing

2.1 Scope of the Processing of Personal Data

When you contact us as a client or interested party, we collect personal data. This occurs, for example, when you are interested in our services, contact us by email, fax or telephone, or use our products and services within existing business relationships.

In these contexts, we process personal data such as first and last name, address, email address and telephone number.

In addition, we process contractual data (e.g. subject matter of the contract, contract duration) and payment data (e.g. bank details, payment history) of our clients, interested parties and business partners for the performance of contractual services as well as for service and client support purposes.

2.2 Legal Basis for the Processing of Personal Data

If the processing of personal data is based on the data subject’s consent, Art. 6(1)(a) GDPR serves as the legal basis.
If personal data is processed for the performance of a contract to which the data subject is a party, Art. 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations necessary to carry out pre-contractual measures.
If processing is necessary for compliance with a legal obligation, Art. 6(1)(c) GDPR serves as the legal basis.
If processing is necessary to protect vital interests of the data subject or another natural person, Art. 6(1)(d) GDPR serves as the legal basis.
If processing is carried out to safeguard the legitimate interests of our company or a third party, and the interests, fundamental rights and freedoms of the data subject do not override those interests, Art. 6(1)(f) GDPR serves as the legal basis.

2.3 Cooperation with Processors and Third Parties

If, in the course of our processing activities, we disclose data to other persons or companies (processors or third parties), transmit data to them or grant them access to data, this only takes place on the basis of a legal permission (e.g. data transfer required for contract performance pursuant to Art. 6(1)(b) GDPR), consent, a legal obligation, or our legitimate interests (e.g. when using service providers or web hosting providers).

If we commission third parties to process data on the basis of a so-called data processing agreement, this is done in accordance with Art. 28 GDPR.

2.4 Transfers to Third Countries

If we process data in a third country (i.e. outside the European Union or the European Economic Area) or this occurs in the context of using third-party services, this only takes place if it is necessary for the fulfillment of our (pre-)contractual obligations, based on consent, due to a legal obligation, or based on our legitimate interests.

Data is processed only if the requirements of Arts. 44 et seq. GDPR are met, meaning that data is processed only if appropriate safeguards are in place, such as an adequacy decision by the European Commission or the use of standard contractual clauses.

2.5 Data Deletion and Storage Duration

Personal data will be deleted or its processing restricted (“blocked”) as soon as the purpose of storage no longer applies. If European or national regulations, laws or other provisions to which we are subject require longer storage, the personal data will be stored accordingly beyond the original purpose.

2.6 Data Deletion upon Withdrawal of Consent

All data collected up to the point of withdrawal will be deleted immediately, unless statutory retention obligations require further storage.

3. Rights of the Data Subject

You have the right to access information about your personal data.

You have the right to rectification (pursuant to Art. 16 GDPR).

You have the right to erasure or restriction of processing (pursuant to Arts. 17 and 18 GDPR).

You have the right to data portability (pursuant to Art. 20 GDPR).

You have the right to lodge a complaint with a supervisory authority (pursuant to Art. 77 GDPR).

4. Data Collection on Our Website

4.1 Server and Log Files

Our hosting provider collects the following data for statistical analysis: IP address of your device at the time of access, date, time, accessed content, the referring website, operating system and browser, and hostname of the accessing device.

4.2 Forms Requiring Input (Contact Form)

Our website provides a contact form. We store the data transmitted via the contact form input fields and process it solely for the purpose of contacting you. The following data is collected: email address, name, telephone number and reason for contact.

The legal basis for processing this data is a (pre-)contractual obligation or your consent provided by submitting the form. You may withdraw your consent at any time with effect for the future (informally by email or post).

4.3 Email Contact

Our website contains one or more email addresses through which you may contact us. Personal data transmitted via email is stored and processed solely for contacting you. The following data may be collected: email address, salutation, last name, first name, telephone number and reason for contact.

The legal basis for processing this data is a (pre-)contractual obligation or your consent. You may withdraw your consent at any time with effect for the future.

4.4 Online Forms

Our website is linked to a button for online data submission, which gives you the option to transmit data to us via an online form. If you use this online service provided by NotarNow (LegalNow GmbH, Lena-Christ-Straße 2, 82031 Grünwald), your information, including the contact details you provide there, will be temporarily stored automatically on NotarNow’s servers for the purpose of processing your request and in case of follow-up questions, and will then be forwarded to us. Data transmission is encrypted using transport encryption via Secure Socket Layer (SSL/TLS).

The storage of the data serves solely the purpose of processing the request or contacting the data subject. The data will not be disclosed to any other third parties. The legal basis for processing the data is Article 6(1)(b) GDPR, insofar as your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Article 6(1)(f) GDPR) or on your consent (Article 6(1)(a) GDPR), provided that such consent has been obtained.

The data you enter in the online form will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

When using the “Save temporarily” function, your online form entries are stored in encrypted and anonymized form for 30 days. If the online form is not submitted to us within these 30 days, the form entries will be completely deleted automatically. In this case, a request for deletion on your part is not required.

5. Analytics and Online Marketing

Cookies are text files sent to your computer when using websites in order to recognize it. Cookies help facilitate website usage and customize content. You can configure your browser to notify you of cookie transmissions or reject cookies. Instructions can be found in your browser’s help section.

Our website does not use non-essential cookies or tracking technologies.

6. Social Media: Online Presences and Plug-ins

We maintain online presences on social media platforms (LinkedIn).

When accessing social networks or platforms, the respective operators’ terms and data processing policies apply.

7. Third-Party Services, Tools and Content

7.1 Use of Fonts

The fonts used on this website are embedded locally on our server. No connection to external font providers or third-party servers takes place. As a result, no personal data, such as users’ IP addresses, is transmitted to third parties when the website is accessed.
